Attys for D Ellsberg and A Russo argue in Fed Dist Ct, Los Angeles, on June 5, that ct should permit pretrial hearing of witnesses that would show that leaks of classified documents are routine practice of Washington officials; Ellsberg's atty C Nesson argues that evidence would show that prosecution of Ellsberg and Russo is discriminatory; Dept of Justice prosecutor D R Nissen opposes hearing on ground that discriminatory prosecution has never been held proper defense in Fed cts; says person guilty of crime cannot be excused simply because others who are guilty are not prosecuted; Ellsberg's atty G Uelman says charges should be dismissed because indictment was not properly signed; contends that Nissen, who signed indictment as Special Asst Atty Gen, was not authorized under law to do so; argues that former US Atty in Los Angeles R L Meyer had refused to sign indictment and that Nissen had no authority to do so; Nissen replies that his apptmt as Special Asst Atty Gen authorized him to carry out all functions that are properly delegated by Atty Gen, including signing of indictment; Judge W M Byrne Jr asks that prosecution and defense work out procedures under which affidavit might be submitted to ct; Nesson says he is prepared to offer affidavit from NY Times Washington Bur chief M Frankel that would document routine leaks of classified information to press

Judge W M Byrne Jr rules on June 6 that prosecution in pretrial arguments on Pentagon papers case must choose between conflicting counts in indictment charging D Ellsberg and A Russo with theft of Govt documents; defense had asked dismissal of 2 counts of indictment on ground that they are mutually exclusive because 1 charges that Ellsberg has unauthorized possession of papers while other charges that he had lawful possession but put papers to unauthorized use

NY Times survey of Calif's 4 largest media mkts indicates that Sen McGovern is is getting more attention in media; finds he is getting about 1/3 more space in newspapers and 1/2 more of free TV time on newscasts; figures do not suggest that eds of 10 newspapers and 13 TV stations involved are inclined to back McGovern over Humphrey; do suggest that McGovern's rise to leading Dem Pres aspirant is most newsworthy story of '72; also that McGovern's orgn, with more money and large staff, has been able to organize smooth publicity operation that helps out newspaper and TV in filing stories; that McGovern effort to capitalize on series of secondary stories dealing with family campaigning orgns that have backed McGovern's campaign orgn; survey was conducted from May 29 through June 2 in 4 of state's media mkts; survey's findings detailed; also found that McGovern profited from June 1 Calif Poll conducted by M Field; McGovern forces in Calif expect to spend about $450,000 for radio and TV ad while Humphrey backers reptdly expect to spend only 1/2 that amt; McGovern forces were able to capture more TV attention by producing extra 'events'; backing of McGovern by Calif ex-Gov Brown noted
