Sup Ct on May 25 refuses to consider case asking how far news media may go in disclosing truthful facts about person's private life; lets stand decision of US Ct of Appeals for 9th Circuit in San Francisco refusing to dismiss $12-million privacy suit against Time Inc; effect of action is to send case back to Fed judge to determine whether it should be submitted to jury; suit was filed by Michael J Virgil on basis of article which appeared in Feb 22, '71, issue of Sports Illustrated and dealt with devotees of sport of body surfing, including Virgil; Time, which publishes Sports Illustrated, moved for dismissal of Virgil's suit, arguing that article was protected by freedom-of-press guarantee in 1st Amendment; US Dist Judge Gordon Thompson Jr denied motion; Time then appealed to appeals ct (S)
